PRIVACY POLICY
CargoMetrics Technologies Inc.
I. Introduction
This Privacy Policy (the “Policy”) describes the type of information that CargoMetrics Technologies Inc. (the “Company” or “we”) gathers from users of the Company’s website (the “Site”) and how the Company uses that information. By accessing or using the Site, you acknowledge that you have read, understood and consent to the data practices described in this Privacy Policy and our Terms of Service. If you do not agree to these terms, do not access or use the Site.
The Site is intended to provide users with information about the Company and provide users with the opportunity to communicate with the Company on certain discrete issues (all users of the Site, “Users” or “you”).
The Policy does not apply to information that is not collected through the Site, including information that is collected by any third party website, app, or service, or information that is provided to the Company in some other way (such as by mail or in-person). Third party websites, apps, and services have their own privacy policies, which we encourage you to read and understand prior to use.
The Policy is a part of the Company’s accompanying Terms of Service.
The Company reserves the right, at its sole discretion, to change the Policy at any time, which change will be effective 10 days following posting of revisions to the Policy on the Site. Your continued use of the Site 10 days following such posting means you accept those changes.
If the Company makes a material change in how we use Personal Information under the Policy, the Company will notify you by means of a notice on the Site prior to the change becoming effective.
II. What Information Does the Company Collect?
The Site occasionally collects Personal Information from or about Users. “Personal Information” means information that can be used to identify an individual. The Company may also collect information that may not be used to identify an individual.
A. Information We Collect
The Company collects information in the following ways:
1. Information Users Provide Directly
The Company collects Personal Information and other information directly provided by Users as part of using the Site, such as information as part of an inquiry regarding employment, information submitted as part of sending a question to the Company, or information submitted in order to receive additional information from the Company. Such information may include name, address, email address, and other information that a User chooses to submit.
2. Automatic Information Collection
The Company may gather information about the device that a User uses to access the Site, such as the following:
- Usage Details – The Company may automatically collect certain details of access to and use of the Site, including traffic data, location data, logs, and other communication data and the resources that you access and use on or through the Site.
- Device Information – The Company may collect information about your device and internet connection, including the device’s unique device identifier, IP address, operating system, browser type, and mobile network information.
3. Information Tracking
The Company may use various technologies to collect information about and track use of the Site.
- Cookies – A cookie is a small file placed on your device by the Site. It is possible to configure devices to refuse to accept cookies; however, doing so may make parts of the Site not function properly.
- Web Beacons – Portions of the Site may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the Company, for example, to count users who have visited those pages and for other related statistics (for example, recording the popularity of certain content and verifying system and server integrity).
III. Use of Information
The Company may use information from Users to operate, improve, and deliver the Site. These uses may include providing you with a more effective User experience; making the Site easier to use by eliminating the need to enter the same information repeatedly; performing research and analysis aimed at improving the Site; diagnosing or fixing problems with the Site; and displaying content customized to your interests, preferences, and location.
The Company also uses information from Users to communicate with Users. The Company may send certain mandatory service communications, such as welcome letters, information on technical service issues, and security announcements.
If you register and provide your email address, we will send you administrative and promotional emails. If you wish to opt out of promotional emails, you may do so by following the “unsubscribe” instructions in the email. All users receive administrative emails, and so you cannot opt out of them.
IV. Sharing and Disclosure of Information
The Company will not share Personal Information except as provided for by this Policy. The Company may also share other information as provided by this Policy.
A. Affiliates
The Company may share information collected by the Site with businesses that are legally part of the same group as the Company, or that become part of that group.
B. Third Party Service Providers
The Company may occasionally hire service providers to provide limited services on its behalf, such as providing customer support, hosting websites, or performing statistical analysis. These service providers will be permitted to obtain only the Personal Information they need to deliver services to the Company. They will be required to maintain the confidentiality of the information and will be prohibited from using it for any other purpose, and to treat such Personal Information in accordance with this Policy.
C. Other Disclosures
The Company may disclose Personal Information or other information collected from Users if the Company has a good faith belief that disclosure of such information is helpful or reasonably necessary to: (i) comply with any applicable law, regulation, legal process or governmental request; (ii) enforce any applicable terms of service, including investigations of potential violations thereof; (iii) detect, prevent, or otherwise address fraud or security issues; or (iv) protect against harm to the rights, property or safety of the Company, our Users, yourself or the public. The Company may be required to disclose Personal Information in response to a lawful request by a public authority, including to meet national security or law enforcement requirements.
D. The Company may disclose your personal information with your consent.
E. Information that is Not Personal Information
The Company may use information collected from Users that is not Personal Information (that is, information that cannot be used to identify an individual User) or disclose it to third parties for any lawful purpose.
F. Business Transitions
If the Company is acquired by or merged with a third party entity, or if it is subject to a bankruptcy or any comparable event, the Company reserves the right to transfer or assign Personal Information in connection therewith.
V. Other Information
A. Security, Confidentiality and Integrity of Personal Information
The Company follows generally accepted industry standards, including the use of appropriate administrative, physical and technical safeguards, to protect Personal Information. No method of transmission over the Internet or method of electronic storage, however, is 100% secure. Therefore, while the Company uses commercially reasonable means to protect Personal Information, the Company cannot guarantee its absolute security or confidentiality.
Please be aware that certain Personal Information and other information provided by you in connection with your use of the Site may be stored on your device (even if that information is not collected by the Company). You are solely responsible for securing your device against unauthorized access.
B. International Transfer of Data
Personal Information may be stored and processed in the United States or any other country in which the Company or its affiliates, subsidiaries, or agents maintain facilities. By using the Site, you consent to any such transfer of information outside of your country. The Company may transfer your Personal Information to affiliated companies for the purpose of storing or processing such information on its behalf. Such information may be transferred to other countries.
The Company and its servers are located in the United States and are subject to applicable local, state, and federal laws. Those who choose to access the Site do so on their own initiative and at their own risk, and are responsible for complying with all laws, rules, and regulations. Users who choose to access or use the Site consent to the use and disclosure of information in accordance with this Policy and subject to such laws. The Company may limit the Site’s availability, in whole or in part, to any person, geographic area, or jurisdiction we choose, at any time and in our sole discretion. The Company does not represent or warrant that the Site, or any part thereof, is appropriate or available for use in any other jurisdiction.
C. Children’s Privacy
The Site is directed to and structured to attract Users age 18 and older. If you are under age 18, you are not permitted to use the Site. The Company does not knowingly collect Personal Information from Users under age 18. D. Users in California
Users who are residents of California have several additional rights under the Policy:
- The right to request the following categories of information:
- The categories of Personal Information collected by the Company.
- The sources of Personal Information collected by the Company.
- The business purpose for collecting Personal Information.
- The third parties with whom the Company shares Personal Information.
- The specific Personal Information the Company has collected about you.
- The right to exercise any of the rights above by contacting us at info@cargometrics.com or by a phone call to the number on our website.
The Company honors “do not track” signals and does not track, use cookies, or use advertising when a “do not track” mechanism is in place.
The Company does not authorize the collection of personally identifiable information from our users for third party use through advertising technologies.
E. Privacy Settings/Opt Out
If you would like your name and email address permanently removed from our database, please contact us at privacy@cargometrics.com. We will promptly delete your name and email address and you will no longer receive email from CargoMetrics. Your removal from the mailing list or database will not remove data you have submitted to us or records of past use of the Site, nor delete information stored in our data backups and archives. Such data will be maintained and/or deleted in the ordinary course of CargoMetrics’ business.
